Introduction

Welcome to Switchbuddy ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the Switchbuddy service (the "Service"), which includes our website and web application at www.switchbuddy.com.au and our mobile applications for iOS and other platforms. The Terms apply however you access the Service. By creating an account, or by otherwise accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

What Switchbuddy Does

Switchbuddy lets you: Upload or photograph your electricity bills. Extract usage, rate and cost information from those bills automatically. Compare your current plan against energy plans published by Australian retailers and see estimated costs and potential savings. Link out to a retailer's own website if you decide to look into one of their plans. We provide these features to help you understand your energy usage and explore potential savings.

What Switchbuddy Does Not Do

We do not switch you to a new retailer and we cannot do so on your behalf. Switchbuddy is an information and comparison service only. We are not an energy retailer, a broker or an agent of any retailer and we do not arrange, submit, negotiate or complete a transfer of your energy account. Where you choose to act on a comparison, the Service links you to the relevant retailer's own website, where you can enter your details and review the plans they offer. Any contract for the supply of energy is entered into directly between you and that retailer, on their terms and is subject to their eligibility criteria, pricing and approval. We are not a party to it. Whether a plan shown in the Service is actually offered to you at your address is a matter for the retailer.

Fees and How We Are Paid

Switchbuddy is currently free to use. We do not charge you for the Service and we do not currently receive any commission, referral fee or other payment from energy retailers. In future we may enter into referral or commission arrangements with retailers, under which we could be paid if you take up a plan after following a link from the Service. If that happens, we will disclose it in the Service and update these Terms. Any such arrangement will not change the way plans are ranked or compared — comparisons are based on your bill data and published plan data only.

No Financial Advice

Switchbuddy provides estimates and comparisons only. We are not a financial adviser and nothing in the Service is financial, legal or taxation advice. Our figures are estimates based on the information read from your bill and on plan data published by retailers and your actual costs will depend on your future usage and on the terms the retailer offers you. We do not guarantee that switching retailers will result in savings, or that any plan shown is the cheapest available to you. You should consider your own circumstances and, where appropriate, seek independent advice before making a decision.

Accounts & Security

To use certain features, you must create an account. You are responsible for keeping your login details secure. You must not share your account with others. If you suspect unauthorised access, you must notify us immediately at support@switchbuddy.com.au We reserve the right to suspend or terminate accounts that misuse the Service.

Your Data

Bills you upload are stored securely in Google Cloud Storage and linked to your account. You may delete your bills or your entire account at any time. Our handling of your data is explained in the Privacy Policy.

Accuracy of Bill and Plan Information

The Service reads your bill automatically using third-party artificial intelligence and compares it against plan data published by retailers. Both inputs can be wrong. A photograph may be misread; a bill may use a format or tariff structure we do not handle correctly; and published plan data may be out of date, incomplete or inaccurate at the time you see it. You should check the figures shown against your own bill before relying on them and confirm current pricing with the retailer before making any decision. We do not warrant that information in the Service is accurate, complete or current.

Acceptable Use

You agree not to: Use the Service for unlawful or fraudulent purposes. Attempt to reverse engineer, hack, or disrupt the Service. Upload material that you do not have the right to share.

Intellectual Property

The Service, its design, features and content are owned by Switchbuddy and protected by intellectual property laws. You may use the Service for personal, non-commercial purposes only. You must not copy, modify, or redistribute the Service without our written permission.

Third-Party Services

The Service relies on third parties, including OpenAI (which processes your bill to extract its details), Australian energy retailers and the Consumer Data Right product data feeds (which supply the plan information we compare),and Google Cloud (hosting and storage). We are not responsible for the availability, accuracy, or security of third-party services, or for the content of any retailer website we link to.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. If we fail to meet a consumer guarantee and that failure does not relate to a good or service of a kind ordinarily acquired for personal, domestic or household use, our liability is limited (at our option) to resupplying the Service or paying the cost of having it resupplied.

Limitation of Liability

Subject to the "Australian Consumer Law" section above and to the maximum extent permitted by law: Switchbuddy is not liable for any indirect, incidental or consequential damages. We are not responsible for losses arising from inaccurate bill parsing or incorrect, incomplete or out-of-date plan data. We are not responsible for the acts or omissions of any energy retailer, including whether a plan is offered to you, the price you are ultimately charged or how a transfer of your account is handled. The Service is provided free of charge and our aggregate liability to you is limited to the amount (if any) you have paid us.

Changes to the Terms

We may update these Terms from time to time. Updates will be posted at www.switchbuddy.com.au/terms with a "last updated" date. Where changes are material, we will ask you to accept the updated Terms in the Service. Continued use of the Service after changes means you accept the new Terms.

Termination

We may suspend or terminate your account if you: Breach these Terms. Misuse the Service. Engage in activity that may harm other users or Switchbuddy. You may terminate your account at any time by requesting deletion in the Service or by contacting us.

Governing Law

These Terms are governed by the laws of Australia. Disputes will be handled in the courts of Victoria, Australia.
